Overview

Welcome to Holyshirt. In these terms, "we", "us" and "our" mean WAH TAT LEE TAILOR GARMENT CO., a company incorporated in Hong Kong, of 27/F D2 Maxgrand Plaza, San Po Kong, Hong Kong. We operate this store and website, including all related information, content, features, tools, products and services (the "Services").

We are the seller. When you buy a shirt from holyshirt.online, your contract is with us.

Australian customer service is provided on our behalf by our Melbourne team. You can reach us at:

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms & Conditions, together with our [Refund & Return Policy] and [Privacy Policy], describe your rights and responsibilities when you use the Services. Please read them carefully.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.


1. Access and account

By agreeing to these Terms, you confirm that you are at least 18 years of age.

To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your email address, billing, payment, delivery and measurement details. You confirm that the information you provide is correct, current and complete.

You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer, sell, assign or license your account to another person.


2. Our products

Every shirt we make is cut to order, to the measurements and options you submit. Nothing is made until you order.

We have made every effort to represent our products accurately. However, fabric colours and product appearance may differ from how they appear on your screen, depending on your device and its settings. Natural fabrics such as cotton and linen may vary slightly between production runs.

Product descriptions, fabrics and options may change or be discontinued at any time. We may limit the quantities we offer to any person or region.

Nothing in this section limits the consumer guarantees described in section 7.


3. Orders

When you place an order, you are making an offer to purchase. We may accept or decline any order. Your order is accepted when we send you an order confirmation email, and we must have received your payment before that happens.

Please review your measurements and options carefully before submitting. Because each shirt is cut to order, we may be unable to change or cancel an order once production has begun. If you need to change something, email us immediately and we will do what we can.

If we decline, change or cancel an order, we will contact you using the details you provided, and you will receive a full refund of anything you have paid.

Returns, remakes and refunds are dealt with in our [Refund & Return Policy]. Where these Terms and that policy differ, the Refund & Return Policy applies.

Our shirts are sold for your own personal or household use, not for commercial resale.


4. Prices and payment

All prices are displayed in Australian dollars and are the total price you pay at checkout, including delivery where stated.

Orders with a customs value of A$1,000 or less are not subject to import duty or GST at the Australian border, so there is nothing further to pay when your parcel arrives.

Prices, discounts and promotions may change without notice. The price that applies to your order is the price shown at the time you place it, as set out in your order confirmation email.

Promotional offers apply only to the products and periods stated in the offer. Unless we say otherwise, one discount code may be used per order. Codes have no cash value, cannot be applied to past orders, and may be withdrawn at any time — orders already placed are not affected. Promotional pricing is not available for resale.

You confirm that the payment details you provide are true and complete and that you are authorised to use the payment method.


5. Shipping and delivery

We deliver to Australian addresses.

We aim to deliver within 14-21 business days of your order being confirmed. Delivery times are estimates. Customs processing, courier delays and public holidays can add time, and we are not responsible for delays outside our control. If your order is running late, we will tell you.

Risk in the goods passes to you on delivery.

Nothing in this section limits your rights under section 7 if goods are not delivered within a reasonable time.


6. Fit, measurements and remakes

Your body measurements are converted by our tailors into shirt measurements, adding the ease a shirt needs to fit and move. We send you the final shirt measurements with your order.

  • If we produce a shirt incorrectly, outside our stated tolerance, or with a fault in materials or workmanship, we will refund you in full or remake the shirt free — your choice.
  • If the shirt matches the measurements you gave us but does not fit as you hoped, that is not a fault. We will still remake it once, free, on your first order.

Non-iron and wrinkle-resistant fabrics require minimal or no ironing when hung promptly after washing. They are not crease-proof. Natural fabrics may shrink slightly on first wash; our patterns allow for this. Please follow the care label — damage caused by washing contrary to the care instructions is not a fault.


7. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Anything we offer in addition to those rights — including the free remake described in section 6 — is additional to them, not a substitute for them.

If any provision of these Terms would otherwise have the effect of excluding, restricting or modifying such a right, that provision applies only to the extent the law permits.


8. Intellectual property

Our Services, including all trademarks, brands, text, images, graphics, video, audio, and the design, selection and arrangement of them, are owned by us, our affiliates or our licensors, and are protected by Australian, Hong Kong and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent.

Holyshirt's names, logos, product names, designs and slogans are our trademarks or those of our licensors, and must not be used without our written permission. Shopify's name, logo and marks are trademarks of Shopify. All other marks belong to their respective owners.


9. Third-party tools and links

Our Services may give you access to tools, functionality or hyperlinks provided by third parties, which we do not control.

We provide access to those tools as they are made available to us and we do not endorse them. Your use of them is at your own discretion, and you should review the third party's own terms and privacy practices before using them. We are not responsible for the content or accuracy of third-party websites.

This section does not limit our obligations to you under section 7 in respect of the products we sell.


10. Relationship with Shopify

Holyshirt is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with us. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and us, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us, to the extent permitted by law.


11. Privacy

All personal information we collect through the Services is subject to our [Privacy Policy]. Certain personal information may also be subject to Shopify's privacy policy.

Because the Services are hosted by Shopify and we operate from Hong Kong, information you submit — including your measurements — will be transmitted to and stored by us and by service providers who may be located outside Australia. Our Privacy Policy explains where your information goes and how it is handled.

We do not sell your personal information.


12. Feedback and reviews

If you send us ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display it, including for promotional purposes.

You confirm that you own or have the rights to any Feedback you submit, that it is your own honest opinion, and that you have told us about any payment, free product or other incentive you received in connection with it.

We are not obliged to keep Feedback confidential, to pay for it, or to respond to it. We may remove Feedback that is unlawful, offensive, defamatory, obscene, or that infringes someone else's rights.

You must not submit Feedback under a false identity or misrepresent where it came from.


13. Errors, inaccuracies and omissions

Occasionally information in our store may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges or availability.

We may correct errors and update information at any time. If an error affects an order you have already placed — for example, a price that was obviously wrong — we will contact you, and you may choose to proceed at the correct price or cancel for a full refund. We will not simply cancel your order without telling you.


14. Prohibited uses

You may use the Services for lawful purposes only. You must not use the Services:

  • for any unlawful or malicious purpose, or to breach any law
  • to infringe our intellectual property rights or those of others
  • to harass, abuse, defame, intimidate or harm our staff or any other person
  • to transmit false or misleading information
  • to send spam, chain letters or unsolicited promotional material
  • to impersonate any person or entity
  • to upload viruses or malicious code
  • to reproduce, duplicate, copy, resell or exploit any part of the Services
  • to collect or track other people's personal information
  • to use robots, spiders, scrapers, automated data-extraction tools or AI agents to access the Services, except as permitted in section 15
  • to interfere with, bypass or circumvent our security measures

If you seriously or repeatedly breach this section, we may suspend or terminate your access to the Services. Where it is reasonable to do so, we will give you notice first and an opportunity to fix the problem.


15. Automated agents

This section applies if you use, allow or enable an Agent to access or interact with the Services. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of a person, without direct supervision.

An Agent may access the Services only if it identifies itself and complies with this section at all times. We may limit, including by technical measures, whether and how any Agent accesses the Services.

Agents must:

  • identify themselves in all HTTP/HTTPS requests by including Agent/[agent name] in the user agent string
  • not conceal that access is automated, including by mimicking human interaction patterns or circumventing CAPTCHAs
  • answer truthfully any prompt seeking to determine whether interactions come from a human
  • not circumvent measures intended to block, limit or control automated access


16. Termination

Either of us may stop using or providing the Services. If we suspend or terminate your access, we will give you reasonable notice unless we are unable to because of a serious breach, a legal requirement, or a risk to security or to other people.

Termination does not affect any order we have already accepted, or any rights you have under the Australian Consumer Law in relation to products already supplied.

The following sections survive termination: Intellectual Property, Feedback and reviews, Your rights under the Australian Consumer Law, Disclaimer, Limitation of liability, Severability, Governing law, and Privacy.


17. Disclaimer

The general information on our website — such as style guidance, fabric explanations and measuring advice — is provided for general information only. While we take care to keep it accurate, you rely on general information at your own discretion.

Except as expressly stated in these Terms, and subject always to section 7, the Services are provided on an "as is" and "as available" basis. We do not warrant that your use of the website will be uninterrupted, timely, secure or error-free.

Nothing in this section excludes, restricts or modifies the consumer guarantees that apply to the products we sell you under the Australian Consumer Law.


18. Limitation of liability

Subject always to section 7, and to the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost revenue or loss of data arising from your use of the website.

Nothing in this section limits our liability:

  • under the consumer guarantees in the Australian Consumer Law
  • for death or personal injury caused by our negligence
  • for fraud or fraudulent misrepresentation
  • for any other liability that cannot be limited by law

Because our shirts are goods of a kind ordinarily acquired for personal, domestic or household use, we do not seek to limit our liability for failures to comply with the consumer guarantees.


19. Indemnity

You agree to indemnify us against losses, damages, liabilities and reasonable legal costs we incur as a result of a third-party claim arising from your deliberate or negligent breach of these Terms, or your infringement of a third party's rights.

This indemnity does not apply to the extent the loss was caused by us, and it does not apply to any liability of yours that cannot lawfully be shifted to you as a consumer.

We will notify you promptly of any claim we intend to rely on this section for, and we will not settle a claim in a way that imposes an obligation on you without your consent.


20. General

Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, it is severed and the remaining provisions continue in force.

Waiver. If we do not enforce a right or provision, that is not a waiver of it.

Entire agreement. These Terms, together with our Refund & Return Policy and Privacy Policy, form the entire agreement between us in relation to the Services.

Assignment. You may not transfer or assign these Terms without our written consent. We may assign these Terms to another entity, provided doing so does not reduce your rights.

Headings. Headings are for convenience only and do not affect interpretation.


21. Governing law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.

Nothing in this section prevents you from bringing a claim, or making a complaint to a consumer protection agency, in the state or territory where you live.


22. Changes to these Terms

You can review the current version of these Terms on this page at any time.

We may update these Terms from time to time by posting the updated version here. The version published at the time you place an order is the version that applies to that order. Where a change materially affects your rights, we will notify you in accordance with applicable law.
